MOTIVA CAR RENTAL VISITOR PRIVACY NOTICE

1. DATA CONTROLLER
Motiva Car Rental is a registered vehicle-rental trademark belonging to İremtur Oto Kiralama Turizm İml. İnş. San. ve Tic. Ltd. Şti.
İremtur Oto Kiralama Turizm İml. İnş. San. ve Tic. Ltd. Şti. (“Company” or “Motiva Car Rental”) acts as data controller under Turkish Personal Data Protection Law No. 6698 (“Law”).
This Visitor Privacy Notice explains how the personal data of natural persons visiting our Gaziantep and Ankara branches or other Company premises is collected, used, transferred and protected, and describes their rights under the Law.

2. PERSONS COVERED
This Notice applies to customers visiting Company offices and branches; their relatives and accompanying persons; representatives of suppliers, business partners and service providers; courier, maintenance, repair and technical-service personnel; job applicants and meeting visitors; and other persons entering Company premises for any reason.
3. PERSONAL DATA THAT MAY BE PROCESSED
Depending on the nature of the visit and transaction, the following data may be processed:
- Identity data: name, surname and, where necessary for identity verification, limited information appearing on an identity document;
- Contact data: telephone number, email address and employer or organisation;
- Visit data: date, entry and exit time, purpose, person or department visited, appointment and visit records;
- Physical-security data: CCTV images, entry and exit records and visitor Vehicle registration number;
- Customer-transaction data: reservation number, Vehicle delivery and return information, request, complaint or support records, and delivery, return or transaction documents signed during the visit;
- Legal and security data: records relating to incidents, disputes, damage, security breaches or legal proceedings.
The Company does not collect temperature measurements as health data from visitors. If such processing becomes necessary due to legislation or exceptional circumstances, visitors shall be separately informed and the requirements applicable to special-category personal data shall be observed.
4. PURPOSES OF PROCESSING
Personal data may be processed to secure Company offices and branches; monitor visitor entry and exit; prevent unauthorised access and security breaches; plan visits, meetings and appointments; welcome and direct customers; carry out Vehicle delivery and return; resolve reservations, requests, complaints and support matters; protect employees, customers, visitors, Vehicles and other assets; investigate emergencies, incidents and security matters; comply with legal obligations; respond to competent public and judicial authorities; establish, exercise or protect rights; manage disputes and legal proceedings; and conduct recordkeeping, archiving and information-security activities.
5. COLLECTION METHODS
Personal data may be collected through visitor forms, appointment and meeting records, Vehicle delivery and return documents, CCTV systems, information given directly to Company employees, appointments or requests created by telephone, email or the website, and other physical or electronic transaction documents, by automated, partly automated or non-automated means forming part of a filing system.
CCTV systems are used only for security and incident-investigation purposes. They are not used in toilets, prayer rooms or similar private areas. Appropriate notices are displayed in monitored areas.
6. LEGAL BASES
Personal data may be processed under Article 5 of the Law where processing is expressly provided by law; necessary for compliance with the Company’s legal obligations; necessary for entering into or performing a contract; necessary for the establishment, exercise or protection of a right; or necessary for the Company’s legitimate interests provided that the data subject’s fundamental rights and freedoms are not harmed.
Visitor and CCTV records are processed mainly to secure physical premises, protect persons and assets, and pursue the Company’s legitimate interests. If an activity legally requires explicit consent, consent shall be requested separately, freely and only after the relevant information has been provided.
7. TRANSFER OF PERSONAL DATA
Personal data may be transferred, where necessary, proportionate and limited to the relevant purpose, to authorised Company personnel and branches handling the visit, customer transaction or Vehicle delivery; security, IT, archiving, maintenance, technical-support and similar suppliers; lawyers, accountants, auditors and authorised advisers for the establishment, exercise or protection of rights; courts, prosecutors, law-enforcement authorities and other competent public bodies in response to lawful requests or legal duties; and insurers or relevant service providers where necessary to investigate an incident, accident or damage.
Motiva Car Rental does not sell or commercially rent visitors’ personal data. If data is transferred outside Türkiye, the conditions and appropriate safeguards under Article 9 of the Law and applicable legislation are applied.
8. RETENTION
Personal data is retained for as long as required for the relevant purpose and applicable statutory retention and limitation periods. Visitor and CCTV records are kept for a purpose-related, limited and proportionate period considering security needs, the Company’s retention and disposal policy, technical capacity and legal obligations.
If an incident, complaint, damage or legal dispute occurs, relevant records may be retained for the time required to resolve it. When the retention period expires and no other legal basis remains, data is deleted, destroyed or anonymised in accordance with applicable law.
9. DATA SECURITY
The Company applies appropriate technical and organisational measures to prevent unlawful processing and access and to keep personal data secure. Access is limited to persons whose duties require it. Measures are taken against unauthorised viewing, alteration or disclosure of security records.
10. YOUR RIGHTS
Under Article 11 of the Law, you may request to learn whether your personal data is processed; obtain information about processing; learn its purpose and whether it is used accordingly; know the recipients in Türkiye or abroad; request correction of incomplete or inaccurate data; request deletion or destruction where the statutory conditions are met; request notification of correction, deletion or destruction to recipients; object to an adverse result produced solely by automated analysis; and claim compensation for damage caused by unlawful processing.
11. HOW TO APPLY
Requests under the Law may be submitted in writing, together with information and documents sufficient to verify your identity and request, to:

Requests may also be submitted through other methods permitted by the Communiqué on the Procedures and Principles of Application to the Data Controller. Current channels and any Data Subject Application Form are published on www.motivacar.com.
Requests sent from an email address previously registered in Company systems may be submitted to info@motivacar.com. Additional information or documents may be requested to verify the applicant’s identity.
An application should include the applicant’s name and surname; Turkish identity number if the applicant is a Turkish citizen; notification or business address; email and telephone number where applicable; subject of the request; and supporting information and documents.
Applications are concluded free of charge as soon as possible and no later than 30 days, depending on their nature. Where processing creates an additional cost, the tariff determined by the Turkish Personal Data Protection Board may apply.
12. UPDATES
The Company may update this Notice following changes in legislation, business processes or personal-data processing activities. The current version takes effect when published on www.motivacar.com. Where necessary, visitors may also be informed through notices at Company premises or other appropriate methods.
In the event of any discrepancy or difference in interpretation between this English version and the Turkish version, the Turkish version shall prevail, subject to mandatory provisions of applicable law.
