This Privacy and Cookie Policy explains the processing of personal data and the use of cookies when you visit www.motivacar.com or use the website to make a reservation or contact us.

2. SCOPE
This Policy applies to visitors of www.motivacar.com, persons requesting a quotation or making a reservation through the website, users of contact and support forms, and visitors managing their cookie preferences.
Links to third-party websites are governed by those parties’ own privacy and cookie policies. Motiva Car Rental is not responsible for the content or personal-data processing activities of third-party websites.
3. WHAT IS A COOKIE?
Cookies are small text files stored on your device through your browser by a website you visit. They may be used to operate and secure the website, remember preferences, measure performance and, where you have given consent, conduct analytics or advertising activities.
Cookies may be classified as session or persistent cookies according to their duration, and as first-party or third-party cookies according to the party placing them.

Where payment-card data is required, it may be processed through the secure infrastructure of an authorised payment institution or bank. Motiva Car Rental does not retain card security codes processed within the payment provider’s secure infrastructure.
5. PURPOSES OF PROCESSING
Personal data may be processed to operate and secure the website; receive and complete reservation, quotation and rental requests; communicate with and support customers; plan pick-up and return; process payments and invoices; remember preferences; prevent fraud and misuse; comply with legal obligations; establish, exercise or protect legal rights; and, where consent is provided, conduct analytics, personalisation, advertising and marketing.
6. LEGAL BASES
Personal data is processed under Articles 5 and, where applicable, 6 of Turkish Personal Data Protection Law No. 6698. The relevant legal bases may include necessity for entering into or performing a contract, compliance with a legal obligation, establishment or protection of a right, the Company’s legitimate interests provided that fundamental rights are not harmed, and explicit consent where required by law.
Non-essential analytics, functionality, advertising and social-media cookies are used only with your consent. Refusing these cookies does not prevent you from using essential website functions or renting a Vehicle.
7. COOKIE CATEGORIES AND PURPOSES
7.1. Strictly Necessary Cookies
These cookies are required to operate and secure the website, manage sessions, process forms and reservations, and record cookie choices. As they are necessary to provide the website, they may be used on an applicable legal basis without separate consent.
7.2. Functionality Cookies

Personal data may be transferred, where necessary, proportionate and limited to the stated purposes, to authorised personnel and branches involved in reservations and rentals; hosting, software, information-security, call-centre, payment, accounting and technical-support suppliers; banks and authorised payment institutions; competent public, judicial and administrative authorities; and lawyers, accountants, auditors and authorised advisers where required to establish, exercise or protect rights.
Motiva Car Rental does not sell or rent personal data to third parties for commercial purposes.
If personal data is transferred outside Türkiye, the transfer requirements and appropriate safeguards under Article 9 of Law No. 6698 and applicable secondary legislation are applied.
11. RETENTION
Personal data is retained for as long as required for the processing purpose and for applicable limitation, tax, commercial, consumer, accounting and other statutory retention periods. When the relevant period expires and no other legal basis remains, data is deleted, destroyed or anonymised in accordance with applicable law.
12. DATA SECURITY
Motiva Car Rental applies reasonable technical and organisational measures to prevent unlawful processing or access and to keep personal data secure. Nevertheless, no method of transmission over the internet is entirely risk-free. Users should not share passwords or account details with third parties.
13. YOUR RIGHTS
Under Article 11 of Law No. 6698, data subjects may request to learn whether their data is processed; obtain information about processing; learn its purpose and whether it is used accordingly; know the third parties to whom it is transferred in Türkiye or abroad; request correction of incomplete or inaccurate data; request deletion or destruction where the statutory conditions are met; request notification of correction, deletion or destruction to recipients; object to an adverse result produced solely by automated analysis; and claim compensation for damage caused by unlawful processing.

Requests under Law No. 6698 may be submitted in writing, together with information and documents sufficient to verify your identity and request, to:

Applications are concluded free of charge as soon as possible and no later than 30 days, depending on their nature. If the process creates an additional cost, the tariff determined by the Turkish Personal Data Protection Board may apply.
15. CHANGES TO THIS POLICY
Motiva Car Rental may update this Policy due to changes in legislation, technology or processing activities. The current version takes effect when published on www.motivacar.com. Material changes may also be announced through the website where necessary.
In the event of any discrepancy or difference in interpretation between this English version and the Turkish version, the Turkish version shall prevail, subject to mandatory provisions of applicable law.
